Migration law In Australia

The primary focus of the Migration Program has been changed multiple times since 1945(the tie when the first federal immigration portfolio was created). Australia’s immigration policies have changed a lot in 65 years from focusing on attracting migrants (primarily from the UK) which were meant primarily to increase Australia’s population and then shifted to attracting workers and temporary skilled migrants to meet the requirements of skilled labor of their economy.

Four main categories exist under the skilled component of the Migration Program that exists in Australia-

  • General skilled migration: It is for skilled workers who don’t have a sponsor. Migrants, in this category, are selected based on their selected job, age, skills, qualifications, English language ability, and employability.
  • Employer nomination: This is for those who have an employer willing to sponsor them to Australia.
  • Business skills migration: This category encourages successful businessmen to come and settle in Australia. This will help the country in developing new business opportunities for Australian and help increase work opportunities there.
  • Distinguished talent– There is a small category for different people having special talents that would benefit Australia such as sports, musicians, artists, and designers who are internationally recognized and outstanding in their field.

On 1 July 2010, a new Skilled Occupation List was introduced in Australia. It contains 181 occupations listed and identified as being in demand in Australia to ensure that the Skilled Migration Program is demand-driven rather than supply-driven for the benefits of the country. It also specifies that To be eligible for independent skilled migration applicants must have relevant qualifications in occupations mentioned on the SOL. Occupations that have been identified as no, not in demand including- cooks and hairdressers, were removed from the list. The SOL is updated annually as per changes seen in the country.

The family stream of the Migration Program has decreased due to the skill stream reflecting the shift in focus towards the Migration Program which was more closely targeted at meeting the labor needs in the market of the Australian economy.

Noting that during 1996–97 the majority of visas that were granted under the Migration Program were in the family stream, figuring for 50.5 percent of the total migration through the program.

Therefore, the planning scheme shifted such that there were lesser visas given for the family stream. This resulted in the family stream (2009–10) is set at 60 300 visas which represent just 35.7 % of the total program visas.

The family stream comprises four main categories that are listed below:-

  • Partner– This category includes spouses also valid for same-sex partners.
  • Child– Including for the dependent child or step-child, a child adopted, and orphan relatives. Under this category, the child must be below 18 years, not married.
  • Parent and Other Family– This category including an aged and dependent relative.
